Settlements and NDAs seem to be a lot more commonplace in the USA based on reports. Surely because money is involved, that makes it voluntary, right?

And while yes, settlements usually don’t prevent people to write a book or whatever, but you are silenced in the sense you are prevented from pursuing any further justice in the legal system for any potential future victims caught by the same mishap.
